The Spanish National Commission for Markets and Competition (CNMC) has opened for public consultation the text (Circular) that regulates the management of the mechanism to promote the use of biofuels and other renewable fuels for transport purposes. According to article 2.2 of Order ITC/2877/2008 published in the Spanish Boletín Oficial del Estado of 14 October 2008, “biohydrogen” is defined as “hydrogen produced from biomass or other renewable energy sources”.
This document will repeal and replace the previous “Circular 1/2019” of 13 March and will amend “Circular 2/2017” of 8 February, which regulates the procedures for the constitution, management and distribution of the compensation payments fund for the mechanism to promote the use of biofuels and other renewable fuels for transport purposes (CIR/DE/016/19).
During this public hearing process, all interested parties will be able to submit to the CNMC their arguments and their contribution to the technical improvement of this proposal.

This document develops the necessary provisions so that the Biofuel Certification Body can carry out its functions in accordance with the regulations in force. To this end, it establishes the requirements that must be met by the obligated parties to accredit the ownership of a minimum number of Certificates that allow them to meet the new biofuel targets. Specifically, a maximum target of 7.2% for biofuels from agricultural crops and an indicative target of 0.1% for advanced biofuels, as indicated in Royal Decree 1085/2015 of 4 December.
The “Circular” also specifies a series of operational aspects in order to provide the sector with greater legal certainty and to increase guarantees and protection against fraud.
How to participate in the consultation?
Comments can be sent within 20 working days from 28 May and will be made public unless expressly indicated otherwise. They must be sent via the CNMC’s website, indicating as the recipient body the Secretariat of the Council and file number CIR/DE/016/19.
